Inner Circle by Brown Thomas Membership

Membership Details

Inner Circle by Brown Thomas is a Membership service of Brown Thomas Arnotts. Inner Circle Membership gives you a range of benefits for 12 months from the date of activation of the Membership for an annual fee of €350 (the “Fee”). By purchasing an Inner Circle Membership, you accept these terms and conditions.

In order to  become a member of the Inner Circle and avail of the benefits detailed below, the Member will need be a Member of the Encore Loyalty Programme, pay the Fee and have a Brown Thomas or Arnotts online account linked to their Encore loyalty account. The Member can create an Encore loyalty account by downloading the App or online at www.brownthomas.com. Instructions for linking an Inner Circle Membership and Encore loyalty account are included in the Membership pack and are available on the Brown Thomas website.

The start date of your Inner Circle Membership will be specified at the time of purchase. Your Membership will expire 12 months after this date. Membership does not automatically renew.  Should you wish to continue availing of Inner Circle benefits, you will need to renew  your Membership prior to its expiry. Brown Thomas Arnotts will notify Members before their Membership expires.

In order to redeem the below benefits, Members may be required to present their Inner Circle Card.

Inner Circle Benefits

Points earning: Members will collect 5 Encore points for every €1 spent In-store, Online and the App.

Any Encore points earned using an Inner Circle Card will be added to your Encore loyalty account once the Membership term begins.

Every September, points earned in the previous calendar year will expire. See Encore T&Cs for points redemption, exclusions and expiry terms.

Choice of a Luxury Gift: Members may select one complimentary Inner Circle gift from the range of Inner Circle gifts available during the Membership term. Additional products may be introduced to the range of Inner Circle gifts during the Membership term. Only one gift may be selected during the Membership term. This applies to all Inner Circle Memberships, including any subsequent Memberships purchased.

Members will receive email communications detailing the available gifts and providing redemption instructions. Gifts will be delivered to the postal address associated with the Membership account. Gifts cannot be returned or exchanged. All hazardous information, safety warnings, and full ingredient listings for any gifts are provided on the product packaging.

Birthday Treats: Members will receive surprise birthday treats in the period leading up to their birthday. Additionally, Members will earn an extra Encore point for every €1 spent during the week before, on their birthday  and the week after their birthday, for a total of 6 Encore points per €1 spent during this period.

This benefit is only available if the Member has registered their date of birth on their Encore loyalty account.

Free standard online delivery: Members will automatically have free standard delivery on orders placed on Online and via the App. This benefit excludes certain brands or products, such as the purchase of Gift Cards, large items and furniture.

Complimentary home delivery from In-store purchases including gift-wrapping: Members can avail of a free home delivery and gift-wrapping service for their In-store purchases.  

The service is available in selected Brown Thomas and Arnotts stores and delivery will be made on the same day or next day depending on the store, availability of the service and the Member’s delivery address. For same day delivery, requests must be made before 4pm. For next day delivery, requests must be made before 6pm. The service is available only within a radius of 15-kilometres from the store location. Same day delivery available in Brown Thomas Dublin. Next day delivery available in Brown Thomas Cork, Limerick and Galway. This benefit is subject to availability and exclusions such as large items and furniture may apply.

Complimentary clothing alterations with home delivery: A complimentary alterations service is available to Members. Alterations available with this benefit are cuff and hem alterations, sleeve length, skirt/dress length and trouser/jeans length. Home delivery on altered garments is available only where the delivery address is within a 15-kilometre radius of the store where the item was purchased. Members with an address outside of this radius will be able to collect the altered items from the store the items were purchased from. The service is not available in BT2s. This benefit is subject to availability.

Hands-free shopping: A hands-free shopping service is available free of charge to Members and is available in selected Brown Thomas and Arnotts stores. Shopping must be collected on the same day of purchase. All purchases must be collected at least 30 minutes prior to store closing. Members will be required to provide their full name and a mobile number when requesting the service, and to present their receipt when collecting their shopping. This service may be unavailable at certain times and is not currently available in BT2.

Be the first to know with early notification of sales, promotions events, and new product launches: Members will receive emails and App notifications to inform them of imminent Brown Thomas and Arnotts sales, promotions and new product launches and customer events, before they are announced to the public.

Complimentary Beauty room treatments: Members can enjoy up to 2 complimentary In-store beauty services during the term of their Membership. Appointments are for a facial, appointment with a skin therapist or with the Beauty Style Team (60-minute make-up appointment up to a value of €100). No product is included. Members must book in advance and quote their Inner Circle Card number and any applicable redemption code provided when booking. This benefit is subject to availability and is currently available in Brown Thomas Dundrum and Grafton Street only.

Points

Earning Points

Encore points can be earned by Members: 1) on purchases In-store, Online and on the App; and 2) by redemption of Gift Cards.

Encore points cannot be earned by Members: on 1) the purchase of the Inner Circle Memberships 2) the purchase of gift cards; 3) delivery charges; 4) gift wrapping; 5) In-store parking; 6) In-store gratuities; 7) alterations; 8) the purchase of wedding gifts from [    ]; 9) points redeemed; 10) purchase of alcohol 11) purchases made through third-party platforms (including but not limited to Deliveroo).  Brown Thomas Arnotts has the right at its sole discretion to determine from time-to-time which products and services qualify for Encore points and by agreeing to these terms the Member understands and agrees that certain brands may opt out of participation in the Programme.

Encore points earned In-store will be applied to an Encore loyalty account and will be available to spend within 3 days of the In-store transaction or within 3 days of the Online order being shipped. Members can check their Encore points balance online at www.arnotts.ie or www.brownthomas.com.

Redeeming Points

Members can only redeem Encore points In-store, Online or via the App. Points earned using the Inner Circle Membership will be applied to your Encore loyalty account. Every September, points earned in the previous calendar year will expire.

Encore points cannot be exchanged or redeemed for cash at any time.

Encore points have no monetary value and cannot be sold, transferred or otherwise dealt with except in accordance with these Terms.

Members may redeem Encore points as outlined below subject to all applicable laws and regulations and subject also to income tax and other taxes, which shall be the sole liability and responsibility of the Member. Brown Thomas Arnotts does not accept any liability for Encore points accrued on or redeemed from use of the Inner Circle Card without the Member’s knowledge.

Returns/Refunds

On the return of an item that earned Encore points, the number of Points earned on that transaction shall be deducted from your Encore loyalty account. The deduction will occur when (i) a refund is completed In-store in accordance with the Brown Thomas Arnotts Returns & Exchanges policy, or (ii) if the return is an item purchased Online, when the returned item is processed by Brown Thomas Arnotts and the Member’s refund is completed in accordance with the Brown Thomas Arnotts returns and refund policies. In these events, the Points earned on the item returned will not be deducted immediately from the Member’s viewable account balance. Instead, the Member’s viewable Points balance will be frozen until such time as Member earns the equivalent number of Points.

If the Points earned on a transaction have been redeemed by the Member at the time of the return of that item, the Encore loyalty account will show a decrease in an amount commensurate to the value of the returned item.

Where the Points earned on a transaction have been redeemed by a Member prior to the return of an item, this may cause the account to go into a negative balance and the Points balance may temporarily appear as zero depending on the Member’s balance. The Encore loyalty account will only appear as a positive balance once a sufficient number of Points have been accumulated on the account.

If a Member has redeemed Points towards the payment (full or part payment) of an item that is subsequently returned in accordance with the Brown Thomas Arnotts Returns & Exchanges policy, these Points will be credited back on to the Encore loyalty account at the time of the completion of the return of the item.

If a product acquired through the redemption of Points is damaged or defective in any way, your statutory rights when goods are faulty will apply. If the Member chooses not to accept a replacement product, Brown Thomas Arnotts will credit the Encore loyalty account for the number of Points redeemed.

Points Transfer

Points cannot be transferred between Encore loyalty accounts or donated towards social causes.

Allocation of Retrospective Points

If a Member is not in possession of their Inner Circle Card at time of the transaction In-store, the Member can have their points added to their Encore loyalty account by emailing a copy of their receipt via the Contact Us page. It may take up to 30 days before retrospectively added points appear on the Member’s Encore loyalty account. Members can avail of this service up to 14 days from the date of the transaction.

Terms and Conditions

Eligibility

In order to purchase an Inner Circle Membership, purchasers must be at least 18-years-old.

The Programme is only available to customers with a billing address within the island of Ireland. Unfortunately, if a billing address is entered which is outside of the island of Ireland, the earning and redemption of Encore points is not possible.

Brown Thomas Arnotts staff, retired staff and concession staff are not permitted to become Members of the Inner Circle including if the membership is received as a gift.

Membership of the Programme is personal to the Member. Each Member is responsible for the proper use and security of their Inner Circle Card and Encore loyalty points. Where a Member has been given (or where a Member has chosen) a password which enables the Member to access certain parts of Online or the App the Member is responsible for keeping this password confidential.

Membership

This is an exclusive membership program and may be limited to a select number of members.

A notification email of the successful and completed account information will be sent to the Member upon the Membership becoming active.

The Member is obliged to notify Brown Thomas Arnotts in writing of any change in the Member’s address or other Member details. Member addresses can be updated by emailing Brown Thomas Arnotts via our Contact Us page. Alternatively, Members can update their own details Online via the ‘My Account’ section.

Inner Circle Card

The Inner Circle Card is the property of Brown Thomas Arnotts and it must be promptly returned to Brown Thomas Arnotts or destroyed if so requested by Brown Thomas Arnotts.

For the avoidance of doubt, replacement of a lost or stolen Inner Circle Card does not result in the creation of a new Encore loyalty account for the Member. Where the Member’s card is lost or stolen, the Member may download the App and Digital Card. If the Member has already linked their Inner Circle Card to an online account, their Digital Card will be available in the App. If the Member has not linked their Inner Circle Card to an online account, they can download the App and contact us by visiting our Contact Us page to have their Inner Circle Card linked. Alternatively, the Member may request a replacement physical Inner Circle Card which will then need to be linked to the Member’s existing Encore loyalty account. This can also be done by contacting us via our Contact Us page.

Brown Thomas Arnotts does not accept any liability for lost, stolen or damaged Inner Circle Cards.

The Inner Circle Card is not a credit, payment or cheque guarantee card.

Cooling Off Period

You may cancel your Membership, by contacting Brown Thomas Arnotts customer service team, within fourteen (14) days of purchase of the Membership. In the event of such cancellation, any points earned at the higher Membership threshold shall be deducted from your Encore loyalty account and any purchases during the cooling off period shall earn Encore points at the rate of your Encore loyalty tier.

On cancellation or expiry of a Membership

When an Inner Circle Membership is cancelled or expires, the Member’s tier will default to an Encore loyalty tier based on the Member’s spend in the previous calendar year.

Amendments to terms and conditions

Brown Thomas Arnotts may amend these Terms from time to time. If a Member uses their Inner Circle Card following a change in the Terms, the Member will be deemed to have accepted the change. Brown Thomas Arnotts will not be liable for any resulting loss or damage.

Brown Thomas Arnotts reserves the right to change the price of the Membership at any point, details of which shall be provided here. Any changes to this price will not affect any current Inner Circle Membership, should you wish to purchase a new Membership then the new pricing will apply.

Brown Thomas Arnotts may, at its discretion, decline to renew the Programme at any time.

Data Protection Notice

Brown Thomas Arnotts will hold your data for performance analysis of Inner Circle. Further, you accept that Brown Thomas Arnotts may contact you to provide you with recommendations and information about Inner Circle promotions, exclusive events and offers.

Personal data supplied to Brown Thomas Arnotts (e.g. name, address, email, telephone number, date of birth) by a Member during the registration process will only be processed by Brown Thomas Arnotts for the purposes set out below and in accordance with the Brown Thomas Arnotts Privacy Policy. Other than as stated below, no personal data will be divulged to any third parties outside of Brown Thomas Arnotts or its data processors, unless required by law, or in order for us to comply with our legal and regulatory obligations or the protection of our interests or for defence against a legal claim.

Accounts and transactions may be monitored in order for us to comply with our legal and regulatory obligations.

Brown Thomas Arnotts can use the personal data supplied by the Member in order to manage and administer the Programme and improve the way the Programme is run; to help Brown Thomas Arnotts understand Members’ shopping habits; to communicate information to Members; and to provide Members with relevant tailored offers by email, SMS or post, unless the Member opts out of the receipt of such offers in accordance the Privacy Policy as outlined below.

A Member can 'opt out' of such marketing communications at any time, free of charge, if he/she does not want to be contacted by Brown Thomas Arnotts for direct marketing purposes, by ticking the appropriate box on the Registration Form or App or by contacting us via our Contact Us page.

Brown Thomas Arnotts can also use information relating to sets or groups of Members, without identifying Members, to enhance its understanding of Member behaviour and enable Brown Thomas Arnotts to improve its service in general.

A Member has the right to request his/her data currently held by Brown Thomas Arnotts. Members also have the right to rectify, cease processing of personal data or erase his/her personal data under the provisions of the Data Protection Act 2018. Halting processing or deleting personal data relating to the Programme may result in reduced benefits under the scheme.  Subject to applicable law, Brown Thomas Arnotts will provide Member with a copy of his/her personal data in accordance with the Data Protection Act 2018. Brown Thomas Arnotts may request proof of identification to verify Member’s access request. If you have any queries in relation to your personal data, you may contact us by visiting our ContactUs page or email the Data Protection Office (dataprotectionofficer@brownthomas.ie) or write to the Data Protection Officer, Brown Thomas Arnotts Ltd., 92 Grafton Street, Dublin 2. If Member’s personal data held by Brown Thomas Arnotts is inaccurate, the Member should inform Brown Thomas Arnotts in writing so that the necessary amendments can be made or to request that the information be erased or object to processing the relevant personal data as requested by Member.

It is important that Members’ personal data is kept up to date in order that Brown Thomas Arnotts can operate the Programme effectively. If Member wishes to change or update Member’s personal data on his/her Account, Member can do so (i) Online by updating the ‘My Account’ page; (ii) by contacting us via the Contact Us page; or (iii) by changing his or her profile via the Self Service Menu on the App. For customers who have an Online account with both Arnotts and Brown Thomas, changes made to Member personal data on his/her account on each website will be reflected on the other.

Any information provided by you in the registration process or gathered by Brown Thomas Arnotts during any visits to the Programme website shall be subject to the terms and conditions of the Brown Thomas and/or Arnotts website.

Brown Thomas Arnotts may disclose Members’ personal data if it sells or buys any business or assets, in which case Brown Thomas Arnotts may disclose personal data to the prospective seller or buyer of such business or assets. If Brown Thomas Arnotts or all or some of its assets are acquired by a third party, Members’ personal data may be one of the transferred assets. Such disclosure or transfer will not alter a Member’s rights in respect of the use that can be made of personal data by the successor or acquiring company.

Brown Thomas Arnotts may assign and transfer all of its rights and obligations under these Terms without your consent. You may not assign your rights under these Terms without prior written consent of Brown Thomas Arnotts.

By either signing the hard copy registration form, registering Online through the registration form or the sign-up screen on the App, Member agrees to abide by these Terms and this Data Protection Notice.

Some of our in store third party suppliers may operate their own loyalty programmes. Brown Thomas Arnotts shall not be liable to you in relation to these third party loyalty programmes. The third party suppliers shall be data controller in respect of any information given to them and there is no sharing of information with Brown Thomas Arnotts in respect of the personal data collected.

Miscellaneous

All goods left with Brown Thomas or Arnotts shall remain at the sole risk of the Member and Brown Thomas Arnotts does not accept any liability for lost or stolen goods howsoever arising.

All other conditions, warranties or other terms which might have effect between the parties or be implied or incorporated into these Terms or any collateral contract, whether by statute, common law or otherwise, are hereby excluded, including the implied conditions, warranties or other terms as to satisfactory quality, fitness for purpose or the use of reasonable skill and care.

Other than for death or personal injury arising from the negligence of Brown Thomas Arnotts, to the extent permitted by law, Brown Thomas Arnotts shall not be liable for any loss, damage or consequential damage of any nature in contract, tort (including negligence) or otherwise caused by the acceptance of the Terms, entry, or in connection with the Programme.

If any provision of these Terms is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force.

These Terms shall be governed by Irish law and the Courts of the Republic of Ireland shall have exclusive jurisdiction.

Definitions

App” means the Brown Thomas or Arnotts App, available on the Apple IOS operating system and the Android operating system.

Brown Thomas Arnotts” means Brown Thomas Arnotts Limited with its registered offices at 92 Grafton Street, Dublin 2.

Digital Card” means the digital Inner Circle card available on the App;

Encore Loyalty Programme” means the Brown Thomas Arnotts customer loyalty programme;

Gift Card” means a Brown Thomas gift card or Arnotts gift card purchased at any Brown Thomas, Arnotts or BT2 store or at www.arnotts.ie  or www.brownthomas.com or any e-gift cards as provided by Hemmingways, a UK based service provider (or such other service provider).

Inner Circle by Brown Thomas / Inner Circle” means the Membership service provided by Brown Thomas Arnotts the subject of these terms.

Inner Circle Card” means (i) the physical Inner Circle card which can be used in both Brown Thomas and Arnotts; and/or (ii) Digital Card.

In-store” means any Brown Thomas, Arnotts or BT2 store.

 “Online” means via the Brown Thomas or Arnotts website or such other Brown Thomas or Arnotts websites or web-based service as designated by Brown Thomas Arnotts from time to time.

 “Programme” means the programme as described herein, and subject to, these Terms.

Member” means a Member of the Inner Circle Membership service.

Terms” means the general terms of use of the Programme. These Terms govern the Programme operated by Brown Thomas Arnotts. Except as indicated in these Terms, the Programme applies equally to transactions carried out in Brown Thomas and Arnotts.
